20/08/2018 – Il lavoratore demansionato è risarcibile se prova…
Nel corso del rapporto lavorativo, il datore di lavoro ha la facoltà di modificare le mansioni attribuite al dipendente al momento dell’assunzione ( ius variandi). Quando tale modifica comporta un demansionamento in capo al prestatore di lavoro vi possono essere una serie di conseguenze dannose di natura patrimoniale o non patrimoniale (impoverimento della capacità professionale, perdita di ulteriori possibilità occupazionali o possibilità di guadagno) .
Infatti,il datore di lavoro nel procedere unilateralmente a variazioni delle mansioni dovra’ prestare particolare attenzione relativamente:
- alle modalità di esercizio della comunicazione della variazione al lavoratore;
- all’assegnazione delle nuove competenze attribuite al prestatore di lavoro affinche’ non comportino conseguenze dannose per la sua professionalità;
In ogni caso il danno non è ravvisabile in maniera automatica di fronte a qualsiasi tipo di demansionamento: è necessario che il prestatore di lavoro, che ritiene di aver subito il danno, non si limiti a richiamare l’inadempimento contrattuale da parte del datore di lavoro ma fornisca un’idonea dimostrazione del danno allegando “in modo specifico la natura e le caratteristiche del pregiudizio subito”. La Cassazione con sent. n. 330/2018 ribadisce che nel corso di un eventuale giudizio la valutazione del giudice, dovrà basarsi su fatti e rilievi quanto più specifici e rilevanti, dovendosi escludere che sia «sufficiente il semplice richiamo di categorie generali».
