24 Giugno 2017- La Corte di giustizia UE decreta, con una sentenza depositata lo scorso 19 luglio, che il requisito anagrafico previsto dalla normativa italiana circa il contratto a chiamata “Job on call” è legittimo in quanto funzionale a favorire l’occupazione giovanile, permettendo così ai ragazzi sotto i 25 anni di beneficiare di una prima occupazione che faciliti poi la ricerca di un impiego stabile.
Con la sentenza della Corte UE è quindi chiaro che il limite anagrafico fissato dalla normativa non ha carattere discriminatorio e viene riconosciuta alle aziende l’esigenza di un “mezzo flessibile, meno vincolante e meno costoso del contratto ordinario”. Tuttavia occorre ricordare che il contratto a tempo indeterminato resta comunque l’obiettivo principale da promuovere; nonostante ciò gli Stati membri, aggiunge la Corte UE, non sono obbligati ad opporsi a forme meno rigide che favoriscano l’entrata nel mondo del lavoro dei giovani, arginando così episodi di lavoro sommerso e condizioni di disagio sociale.
